Sticky Web (SIKY) stock fraud spamming

Sticky Web, Inc. is a public company (listed on the penny stock pink sheets) that wants to patent spamming.

In May 2005, they bought Taub's spam company, Estrela Marketing (see ROK5607 for details, also information on them getting busted by the WIPO for domain squatting).

In June 2005, Estrela Marketing sent out a stock spam to try and pump up SIKY's stock price. See below for the full spam.

In April 2006, a flood of illegal spam from hijacked botnet proxy servers started hitting inboxes (see ROK6597 for more information). This spam also tried to pump up SIKY's stock price and advertised the website that had been created by them in April to tout their stock and their spam patents.

Note the similarities between the "legal" spam below, and the can-spam violating illegal spam in ROK6597.

General Description:

Sticky Web, Inc.'s (SIKY) business is marketing and commercializing its intellectual property (IP) portfolio through operations and acquisitions.

The SIKY management team begins plan to capitalize on its patent portfolio.

The patent portfolio contains six patents and patents pending. Each of the patents issued and pending in the SIKY portfolio represent building blocks of the Internet methods, software and services.

The patent portfolio encompasses five areas of technology that include the following:

1. Managing Bulk E-Mail Distribution

2. Developing and Posting Electronic Documents

3. Electronic Document Collaboration

4. Access Management of Electronic Documents

5. E-Commerce and Marketing

"METHOD FOR MANAGING BULK E-MAIL DISTRIBUTION" US Patent Number 6,631,400 was issued by the USPTO on October 7, 2003. On August 3, 2004 the second patent, number 6,771,291, "METHOD FOR DEVELOPING ELECTRONIC DOCUMENTS EMPLOYING MULTIPLE DISPLAY REGIONS" was issued.

The 6,631,400 patent gives SIKY a distinct competitive advantage in the OPT-IN e-mail industry. SIKY plans to grow revenue through e-mail service operations.

As part of its plan to capitalize on its patent portfolio SIKY plans to use the 6,631,400 patent to cleanup the e-mail industry with an enforcement strategy.

The estimated market spending on permission-based, or OPT-IN, e-mail marketing, including list rentals is growing to over $7 billion in 2005 according to independent studies by eMarketer, Jupitermedia, META Group/IMT Strategies and Forrester. The market is rich with ASP solutions, installable software solutions, direct marketing service bureaus, e-mail service bureaus as well as niche players in strategy, rich media, content and data management. The 2005 estimates do not include revenues generated by SPAM operations.

Forrester Research has found that 85% of advertisers surveyed plan to increase their online advertising budgets in 2005. Over 40% will also cut advertising spend on magazine, newspaper and direct mail. The online advertising market is predicted to go from $12 billion in 2004 to $ 26 billion by 2010.
